Supreme Court Dismisses Godfred Dame's Objections in Chief Justice Removal Case

Accra, Ghana - 06 May, 2025 - Ghana's Supreme Court has dismissed two objections raised by lawyer Godfred Yeboah Dame, representing plaintiff Vincent Ekow Asafuah, in a case seeking to injunct processes for the removal of the Chief Justice.

The objections sought the recusal of Acting Chief Justice Paul Baffoe-Bonnie and a reconstitution of the panel hearing the motion.

Mr. Dame argued that the Acting Chief Justice had a vested interest in the proceedings and should therefore recuse himself. He also objected to the reconstitution of the panel, citing Article 157(3) of the Constitution, which he claimed prohibited changes to the panel once hearings had commenced.

However, the Supreme Court ruled that Article 144(6) of the 1992 Constitution empowers the Acting Chief Justice to perform all powers of a substantive Chief Justice, including constituting a panel. The court therefore rejected the call for Justice Baffoe-Bonnie's recusal.

The court also dismissed the second objection, holding that the constitutional provisions cited by Mr. Dame did not apply in this context. The ruling allows the case to proceed with the current panel, presided over by Acting Chief Justice Baffoe-Bonnie.

The case revolves around a motion seeking to injunct processes for the removal of the Chief Justice, and the Supreme Court's ruling is a significant development in the ongoing proceedings.
