Supreme Court Quashes Order to Restore Nii Tackie Adama Latse II as Ga Mantse

Accra, Ghana – 23 July, 2025 – The Supreme Court has quashed a High Court order directing the National House of Chiefs to restore Nii Tackie Adama Latse II's name onto the national register of chiefs as the Ga Mantse.

 A five-member panel of the apex court, presided over by Justice Gabriel Scott Pwamang, ruled that the High Court judge, Justice Frederick Tetteh, violated the rule of natural justice by not giving Nii Tackie Teiko Tsuru a notice and hearing before making the order.

 Key Points:

The Supreme Court held that the High Court's decision was flawed because it did not afford Nii Tackie Tsuru his constitutional right to be heard in proceedings that directly affected his rights and interests as Ga Mantse.

The apex court upheld a certiorari application filed by counsel for Nii Tackie Tsuru, Professor Peter A. Atupare, which sought to quash the High Court's order.

Background: 

The dispute began when Nii Adama Latse II's name was removed from the National Register without evidence of his destoolment. He subsequently filed a motion at the High Court in Kumasi, seeking an order to restore his name onto the register.

 

Previous Rulings:

On June 12, 2025, the Court of Appeal ordered the National House of Chiefs to restore Nii Adama Latse's name onto the national register within 14 days. The court held that the National House of Chiefs' decision to remove his name was ultra vires and constituted an abuse of power.

In November 2021, the High Court in Kumasi granted an order directing the National House of Chiefs to restore Nii Adama Latse's name onto the register.

 

Implications:

The Supreme Court's decision means that the order to restore Nii Adama Latse II's name onto the national register of chiefs as the Ga Mantse has been quashed. The substantive matter regarding who rightfully occupies the Ga Mantse Stool remains unresolved and is still pending before the Judicial Committee of the Greater Accra Regional House of Chiefs.
