Accra ,Ghana - A constitutional lawsuit has been filed at the Supreme Court of Ghana, challenging the Ghana Bar Association's (GBA) exclusive recognition in the country's legal framework. The suit was jointly filed by Rockson-Nelson Dafeamekpor, Member of Parliament for South Dayi, private legal practitioner Israel Tetteh, and the Ghana Law Society.

The plaintiffs argue that granting the GBA exclusive status infringes on constitutional rights to equality and freedom of association. They contend that the GBA's monopoly discriminates against other lawyer associations and limits their participation in key governance structures. According to the lawsuit, the Constitution's references to the "Ghana Bar Association" should be interpreted as generic terms encompassing all legally recognized associations of lawyers.

The plaintiffs claim the GBA's exclusive status violates Articles 17 and 21(1)(e) of the 1992 Constitution, which guarantee equality and freedom of association. The GBA's role in judicial appointments, such as the Supreme Court and Court of Appeal, is also being challenged. The lawsuit seeks a reinterpretation of the GBA's role and recognition under the Constitution.

If successful, the case could significantly alter Ghana's legal governance structure, paving the way for multiple legal associations to be recognized in constitutional roles. This could end the GBA's decades-long dominance in public legal affairs and promote legal pluralism.
