Mornah's presidential bid hangs in balance as court adjourns ruling to October 21
Accra, Ghana - October 16, 2024 - An Accra High Court has postponed its ruling on Bernard Mornah's appeal against his disqualification from the 2024 presidential election until October 21.
Mornah, flagbearer of the People's National Convention (PNC), was one of 11 candidates disqualified by the Electoral Commission (EC) due to errors on their nomination forms.
Mornah alleges the EC violated constitutional provisions by not allowing him to rectify the errors. However, the EC disputes this claim, stating that while some errors were pointed out, those deemed criminal in nature were not communicated to the aspirants.
Background of the Case
- Disqualification: Bernard Mornah was disqualified by the EC along with 10 other candidates due to errors on their nomination forms.
- Errors: Mornah's form had incomplete details of supporters, and varying signatures for the same supporters.
- EC's Stance: The EC claims it pointed out some errors but did not communicate those deemed criminal in nature to the aspirants.
In court, Mornah's lawyers argued that the EC acted beyond its discretionary powers. Harold Atuguba, Mornah's lawyer, urged the commission to suspend all electoral activities related to the presidential election until the court reaches a decision.
