Supreme Court Postpones Ruling on Petition Against Chief Justice Torkonoo to May 6

Accra, Ghana - 16 April, 2025 - Ghana's Supreme Court has postponed a crucial hearing on an injunction application seeking to halt President John Dramani Mahama and the Council of State from determining whether there's a prima facie case in the petitions for the removal of the Chief Justice, Getrude Torkonoo.

The adjournment, scheduled for May 6, was necessitated by the absence of one of the five presiding judges, Justice Samuel Asiedu.

Presiding Judge, Her Ladyship Henrietta Mensah Bonsu, cited unavoidable reasons for the adjournment, stating that "we have had problems and for unavoidable reasons have to adjourn." The case has now been rescheduled for May 6.

Meanwhile, Attorney General Dr. Dominic Ayine has dismissed calls for President Mahama to suspend the proceedings related to the Chief Justice's removal in an interview with the press on Wednesday, April 16, after court proceedings.

Dr. Ayine emphasized that the President cannot be restrained from performing his constitutional duties. 

This stance follows a statement by the plaintiff's lawyer, Godfred Yeboah Dame, suggesting that the President should halt proceedings due to the pending injunction application.

“He has applied to the court, and the court is yet to make an order. So, if he is saying that the court must hold on? Is he saying that the court has already granted an order in respect of which the president must not continue the process?” Dr. Ayine questioned.

“He must understand that it is the constitutional duty, and the law is very clear that you cannot enjoin the performance or conduct of a public communication,” he added.
