Movement for Change Defends President Mahama's Decision to Suspend Chief Justice, Cites Constitutional Legitimacy

Accra, Ghana - 29 April, 2025 - The Movement for Change (MFC) throws its weight behind President John Mahama's decision to suspend Chief Justice Gertrude Torkornoo, citing constitutional legitimacy and adherence to due process.
The MFC in a statement issued on Monday April 28, argues that the process has been fair and in accordance with due process, with the Chief Justice given the opportunity to respond to allegations.
“The 1992 Constitution is the bedrock of our democracy,” the MFC said. “The President’s action, taken on the advice of the Council of State and following a prima facie determination, adheres to the procedural framework outlined in Article 146.”
The movement has called on the investigative committee to conduct its work with impartiality and fairness, warning that politicization of the matter could undermine Ghana's democratic principles.
“The President, having set up a five-member committee to look into the petition and subsequently suspending the Chief Justice are steps... well grounded in the constitution of Ghana, which is the soul of the nation,” portions of the statement read.
The group also emphasized that no one is above the law and that accountability must apply equally to all, regardless of status or office. While acknowledging public concerns about transparency, the MFC notes that the Constitution currently does not mandate open hearings in such proceedings and has called for constitutional reforms to increase openness in the future.
The MFC's statement is likely to fuel ongoing debates about the role of the judiciary and the balance of power in Ghana's government. As the investigation into the Chief Justice's conduct gets underway, the MFC is urging the public to remain calm and trust the constitutional process.
