Ghanaian Professor Files Petition to Remove Chief Justice Over Alleged Misbehaviour
A petition has been filed with President Nana Addo Dankwa Akufo-Addo, seeking the removal of Chief Justice Gertrude Torkornoo over allegations of misbehaviour and incompetence.
The petition, submitted by Prof. Stephen Kwaku Asare, cites Article 146 (1) of Ghana's 1992 constitution as the legal basis for the removal.
According to the petition, the Chief Justice's administrative actions, rather than her judicial decisions, are the focus of the allegations. Specifically, the petition highlights the Chief Justice's alleged scheme to influence the appointment of judges, which is said to undermine the constitutional scheme and reduce the Judicial Council and the president to mere rubber-stamps.
The petition also alleges that the Chief Justice has interfered with duly constituted panels, compromising their impartiality and independence. Prof. Asare has requested that members of the Judicial Council be subpoenaed to testify on the matter.
Prof. Asare in a letter dated December 17, noted that “the legal basis of my petition is Article 146 (1) of the 1992 constitution of the republic of Ghana [the constitution]. For the avoidance of doubt, my petition focuses on stated misbehaviour and incompetence related to the Chief Justice’s administrative functions as head of the judiciary responsible for its supervision and administration under article 125 (4) of the constitution.''
