GBA Slams Mahama, Demands Immediate Revocation of Chief Justice Torkornoo's Suspension

Accra, Ghana - 30 April, 2025 - The Ghana Bar Association (GBA) has vehemently criticized the suspension of Chief Justice Gertrude Torkornoo, calling for its immediate revocation.

In a statement dated April 26, the GBA argued that the President's decision was unconstitutional, citing the lack of a published Constitutional Instrument or regulatory framework governing the suspension process.

“The Ghana Bar Association calls for the immediate revocation of the suspension of the Chief Justice as it considers the suspension to be unconstitutional,” portions of the statement read.

The Association contends that the suspension violates Article 296 of the 1992 Constitution, which outlines the principles of administrative discretion.

Furthermore, the GBA is urging the government to establish clear regulations for the impeachment or removal of Superior Court justices under Article 146.

The GBA also demands transparency, calling for the release of the full decision establishing a prima facie case against Chief Justice Torkornoo.

The Association condemned the prejudicial commentary surrounding the matter, warning that it could erode public trust in the judiciary.

“The Association affirms its commitment to safeguarding the sanctity of the judicial process and resolves to take all appropriate legal measures to protect the Judiciary from undue interference or unjustifiable attacks,” the statement added.

This development highlights concerns about the independence of the judiciary and the rule of law in Ghana. The GBA's stance underscores the need for checks and balances in the exercise of executive power.

In recent years, Ghana has been recognized for its robust democratic institutions and respect for the rule of law. The African Union and ECOWAS have praised Ghana's commitment to democratic principles and the protection of human rights.

However, this incident raises questions about the limits of executive power and the protection of judicial independence.

The GBA's call for the revocation of the suspension and the establishment of clear regulations for the impeachment process is a significant development that will likely have far-reaching implications for Ghana's judiciary and democratic institutions.
