Supreme Court Strikes Out Chief Justice Torkonoo's Affidavit in Removal Proceedings

Accra, Ghana - 28 May, 2025 - The Supreme Court has struck out a supplementary affidavit filed by suspended Chief Justice Gertrude Torkornoo, which alleged inhumane treatment and violation of her dignity during the proceedings of the committee investigating petitions for her removal.
A five-member panel of the court upheld an objection by Deputy Attorney General Justice Srem Sai, who argued that the affidavit breached Article 146(8) of the Constitution, which requires proceedings concerning the removal of justices to be conducted in private.
The court ruled that by disclosing aspects of the committee's deliberations in the affidavit, Justice Torkornoo violated the confidentiality provisions under the Constitution.
This decision was made despite arguments by former Attorney General Godfred Yeboah Dame, who represented Justice Torkornoo, that the affidavit was submitted within a judicial forum and not disclosed to the general public.
The court's ruling effectively struck out the affidavit, citing the need to uphold constitutional confidentiality requirements.
