Accra, Ghana - 04 April, 2025 - Ghana's Supreme Court will decide the fate of Chief Justice Gertrude Torkornoo on April 9, 2025, as it hears a landmark case challenging the constitutionality of her potential removal.

A lawsuit filed by Old Tafo MP Vincent Ekow Assafuah claims that President John Mahama violated Ghana's constitution by failing to allow Chief Justice Gertrude Torkornoo to respond to allegations against her before seeking advice from the Council of State.

This alleged oversight centers on Article 146(6) of the Constitution, which, according to Assafuah, guarantees the Chief Justice's right to a fair hearing.

Assafuah, represented by former Attorney-General Godfred Dame, argues that by bypassing the Chief Justice, President Mahama compromised her right to a fair trial and undermined the independence of Ghana's judiciary.

The lawsuit seeks to clarify the constitutional process for removing a Chief Justice and could set a precedent for future cases involving high-ranking officials.
