Supreme Court Halts Sentencing of Akwatia MP Ernest Kumi in Contempt Case

Accra, Ghana - 26 Feb, 2025 - Ghana's Supreme Court has intervened in a contempt case involving Akwatia MP Ernest Yaw Kumi, halting his sentencing by the Koforidua High Court until a final ruling is made on a motion to overturn the decision.

The court's decision, made by a 4-1 majority, comes after Kumi's lawyers argued that the High Court judge erred in assuming jurisdiction over a parliamentary election petition before the Electoral Commission had officially gazetted the election results.

Kumi's counsel, Gary Nimako Marfo, contended that Justice Emmanuel Senyo Amadehe's decision to convict the MP for contempt of court was flawed, as the judge had not followed proper procedures.

The MP had been convicted for defying an interim injunction that barred him from being sworn in as a legislator.

The Supreme Court's stay of execution means that Kumi will not be sentenced until the court makes a final ruling on the motion to quash the High Court's decision.
