Accra High Court dismisses suit against deputy IGP Yohuno's appointment
Accra, Ghana - Nov 5, 2024 - The Accra High Court has dismissed a petition filed by university lecturer Emmanuel Felix Mantey, challenging the appointment of COP Christian Tetteh Yohuno as Deputy Inspector General of Police (IGP) for operations.
Mantey argued that the Police Council and the Office of the President exceeded their authority in creating this role, as it is not recognized by the Constitution or the Ghana Police Service Act.
COP Yohuno's appointment on July 17 was made following the Police Council's advice, acknowledging his exceptional credentials and dedication to duty. However, Mantey claimed that the Police Service Regulations, the only legal document hinting at such a position, does not provide for a deputy solely dedicated to operations.
In his judicial review request, Mantey alleged that the President and the Police Council acted beyond their legal bounds by creating an unauthorized office within the police hierarchy. Justice Richard Apietu dismissed the application, ruling that the High Court's supervisory jurisdiction was not properly invoked.
According to Justice Apietu, the President and the Police Council are not lower adjudicating bodies, and their actions constitute administrative powers, not adjudicatory functions.
This ruling effectively clears the way for COP Yohuno to continue executing his duties as Deputy IGP for operations.
